Greenville Penalties Against Sellers Are Upheld on Appeal
Commission Finds The "Severe Penalty" is Needed
The following is the official NASCAR statement reguarding an appeal in matter matter of a disqualification of Peyton Sellers and the Andy Santerre Motorsports #44 team from an apparent victory in the NASCAR Camping World East Series race at Greenville-Pickens Speedway (SC).

On May 14, 2008, the National Stock Car Racing Commission heard and considered the appeal of crew chief, H.C. Sellers.  The appeal concerned a penalty issued by NASCAR following post-race inspection on the #44 car at the NASCAR Camping World Series event at Greenville-Pickens Speedway on April 19, 2008. 

The infractions concerned Section 12-4-A of the NASCAR Rule Book "Actions detrimental to stock car racing"; Section 12-4-Q "Any determination by NASCAR Officials that the car, car parts, components, and/or equipment used in the Event do not conform to NASCAR rules" and Section 20C-12.3C(7) "Shock absorber base valves will not be permitted:  Right rear shock absorber had a base valve installed."

The penalty assessed was:
Peyton Sellers' #44 Chevrolet
• Suspension from the next three (3) NASCAR Camping World Series East Events.  Suspension from the NASCAR Touring Series until June 11, 2008.  Probation until December 31, 2008.

The Appellant did not contest the legality of the part, but argued the severity of the penalty, particularly in light of other actions taken by NASCAR regarding the official results of that race (car being moved from first place to last place). 

The Commission found that infraction warranted a severe penalty against the crew chief.  The penalty issued was consistent with past penalties issued at this level of the sport for infractions of similar magnitude. 

Therefore, it is the unanimous decision of the National Stock Car Racing Commission to uphold the original penalty assessed by NASCAR.

The Appellant has the right under Section 15 of the Rule Book to appeal this decision to the National Stock Car Racing Commissioner.
